Property owners create an Easement through any one of four ways: expressly through express grant or reservation; by implication; by necessity; or through prescription. Each of these methods of creating an Easement has its own specific requirements to fulfill in order to establish an Easement under their parameters. The following provides a brief description of how a landowner creates an Easement in each of the four aforementioned ways.
